The vacation bench of the Bombay High Court will hear on May 29 an interim application by a lawyer, a resident of Thakur Village, Kandivali (East), who made several complaints to Samta Nagar Police station and had posted live videos on Twitter to show that a mosque is using loudspeakers during early morning hours, despite there being restrictions on the use of loudspeaker between 10 pm and 6 am and the area in question being a silence zone.
The lawyer claimed that despite an assurance given by the government lawyer that the police will comply with the Noise Pollution Rules and HC judgment of 2016 laying down guidelines against noise pollution, the authorities failed to take action against violators.
After the government lawyer sought time to take instructions from the officers and submitted that the department will take some time to mitigate the situation, the bench posted the hearing to Monday.
A bench of Justices Abhay Ahuja and M M Sathaye Friday heard an interim application by lawyer Reena Richard who had submitted that ESIS Hospital was nearby and the area fell under the silence zone. On May 3, the police had assured the Court that it will comply with the Rules and past orders of HC.
The Court, while directing strict compliance with Rules, had sought an affidavit in reply to the plea from the police by June 9 and had posted the hearing in the main petition to June 12.
On Friday, Richard submitted that despite assurance, the police are not able to apply the Rules and the decision in the 2016 order, and did not take cognizance of two complaints that intimated the violation of Noise Pollution Rules. Richard said there was inaction on the police’s behalf and sought direction to the authorities to take action on the complaints.
