Special sessions Judge M L Tahaliyani,hearing the 26/11 attack case,has reserved its order on the prosecutions plea to allow three Federal Bureau of Investigations (FBI) agents to depose through video-conferencing.
The three witnesses are likely to depose on the FBIs investigations on telephone calls by the attackers to their handlers in Pakistan during the attack. The prosecution needs the testimony to back up its allegation that the conspiracy to attack Mumbai was hatched in Pakistan. Defence lawyer Abbas Kazmi has opposed the plea saying there is no extradition treaty between India and US and if a witness gave false evidence he could not be tried for perjury.
Mondays proceedings included a deposition by Samot Asgaonkar,who was travelling with his friend Sharan Arasa in the latters Skoda on 26/11 before it was hijacked by two terrorists near Vidhan Bhavan.
Asgaonkar identified Ajmal Kasab in court as one of the two men who had snatched the vehicle. He said Arasa was giving him a lift and they heard firing near Vidhan Bhavan. We saw a police Qualis approach us near the Inox theatre. Two persons stepped out of the car and asked us to leave the Skoda. Kasabs partner in the drivers seat,the car sped off in the direction of Marine Drive,he added. Asgaonkar said he approached policemen near Vidhan Bhavan,informed them of the incident and heard policemen sending wireless messages.
The prosecution also examined sub-inspector Maruti Zende of Marine Drive police station. Zende had recorded the statements of Arasa and Asgaonkar.
