NGT revokes stay on demolition of five studios in Madh Island

The western zone bench of the National Green Tribunal (NGT) on Thursday revoked the stay on demolition of five studios in the Madh Island while dismissing a plea filed by the studio operators, disallowing them from further operations.

Municipal commissioner Iqbal Singh Chahal had last September ordered an inquiry against unauthorised studios at Madh, Marve, Bhati and Erangal villages in Malad. This was after BJP leader Kirit Somaiya alleged that the studios were built without permission and based on fraudulent documents in the violation of Maharashtra Coastal Zone Management Authority (MCZMA).

Following this, the BMC had demolished six studios in these areas. After Balaji Tirupati Cinemas, one of the studio operators approached the court, a stay was imposed on the five studios that were yet to be demolised.

“We are not in agreement with this argument and find that these structures only show violation of the grant temporary permission given by (authorities). We further find that as per the permission, the structure was to be set up for six months and thereafter, the same had to be removed so that the place could be restored to its earlier position,” the NGT order stated.

“There is blatant violation on the part of appellants because they didn’t remove the structures before moving further application for granting temporary permission for raising construction. This is in total violation of the temporary permission granted to appellants,” the order added.

Civic officials said they will now initiate demolition of these structures.

Somaiya, in a series of tweets, said the demolition work would begin from Friday. “National Green Tribunal today passed an order that studios are illegal, they’ve misused permission & built permanent studios instead of temporary structures. It is observed by the tribunal that studios built up in gross violation of norms,” Somaiya tweeted.
