Missing amenities: Builder told to compensate residents

In a relief to nine residents of a co-operative housing society in Wadala,the Central Mumbai Consumer Dispute Redressal Forum directed a builder to pay over Rs 1,50,000 to each resident for failing to provide the promised amenities.

In a relief to nine residents of a co-operative housing society in Wadala,the Central Mumbai Consumer Dispute Redressal Forum directed a builder to pay over Rs 1,50,000 to each resident for failing to provide the promised amenities.

EMG Green Developers had constructed a 10-storey building in 2005 and promised some basic amenities,including club house,garden,roads,street lights,safety doors etc,to each occupant. However,after the property was occupied,the developer allegedly shirked off his responsibilities.

“Each occupant was made to pay Rs 76,734 for these amenities. But until February 2011,none of these promised amenities were made available to the occupants,” the order states. After several reminders and a legal notice,nine residents moved the consumer forum against the developer. “A legal notice was sent to the developer. No heed was paid to that too,” the complainants claim in their applications.

Each complainant had sought compensation with an interest of 9 per cent for each year till 2011,and an additional Rs 10,000 for mental agony suffered by them.

The developer chose not to appear before the forum.

The forum,headed by president Nalin Majithia and member Bhavna Pisal,directed the developers to pay the amount within a month.
