A special court here on April 18 sentenced a domestic help to five years in jail for sexual abuse of two children living in his employer’s building.
The charges against the accused were that he had shown pornographic videos to the two victims, both below 12 years of age, and then touched them inappropriately.
The man’s employers had deposed in the court in his favour stating that two days before the incident, the victims had sprinkled bubble water in his eyes for which he had scolded them. They had also submitted that the tablet, on which the videos were alleged to have been shown, was never accessible to him and it was password protected.
The court said that apart from the victims, testimonies of the teacher and counsellor from the school where they studied had also been recorded.
“The victim has disclosed incidents to the counsellor of the school and then to principal and then mother. There seems no reason for them to depose against the accused. Both the witnesses are independent wittiness. Hence, there was no need for teachers and counsellor to instigate the informant to file false complaints against him. No parent would ever put their child’s pride at stake and depose falsely about sexual assault,” the court said.
Special Public Prosecutor Veena Shelar had submitted that in January 2016, the teacher had noticed that the elder child was not paying attention in school. The teacher informed the mother and the child was sent to the school counsellor. The child informed the counsellor about the assault. The younger child, too, was later taken into confidence, who also revealed the same incident.
The accused had argued that he was falsely implicated as the children used to tease the dog of his employer when he would take him down for a walk and they had implicated him as he had scolded them.
He also argued that there was no medical evidence.
The court relied on the testimonies of the school staff and the children to convict the accused on charges including Protection of Children from Sexual Offences Act.
