The Bombay High Court has pulled up the Brihanmumbai Municipal Corporation (BMC) for its lackluster approach in dealing with traffic congestion near Don Bosco School in Boriwali (West).
The court observed that bureaucratic apathy has to be replaced with public sympathy. A division bench of Justice S C Dharmadhikari and Justice Revati-Mohite Dere was acting on a Public Interest Litigation (PIL) filed by advocate Rachana Chavan,who in her petition said Don Bosco school is located at the intersection of Chandavarkar Lane,Lokmanya Tilak Road and Linking Road,which witnesses heavy traffic daily. While the island has a bust of Lokmanya Tilak,there is a bus stop in the area besides a triangular island between LT Road and Chadavarkar Lane that has remained incomplete,said advocate Anuuj Narula who was appointed amicus curiae (friend of court) in the case. Motorists face inconvenience because of this,Narula added.
The court expressing its concern said a situation may arise from the congestion when the bust of the national leader will be hit by a car.
Appearing for the BMC,advocate Sharmila Modale informed the court the civic body has already written to the Maharashtra Housing and Development Authority (MHADA) about shifting the bust. However,the court said,How many statues have you have? It is your (BMCs) duty to deal with it…. You have to find a solution.
What you do is point the finger to your left. Nobody works in coordination with each other, said the court. We will give you as much time as you want,but you have to find a solution. It is high time that you do something before 2014, the court said.
When the bench questioned the BMC about the steps taken to shift the bus stop,Modale said the Brihanmumbai Electricity Supply and Transport undertaking (BEST) was informed. BEST,whos she? Its the baby of the corporation. You (BMC) should correct it, said the bench.
The court directed the BMC to take up the issue of shifting the bus stop with BEST and with MHADA for shifting the bust of the national leader. While adjourning the hearing to February 3,2014,the court said the BMCs action should set a precedent for all such issues in the city and serve the larger interest of the society.
