The Bombay High Court Monday extended the stay granted by a city civil court on an order preventing Mumbai Cricket Associations newly appointed president and NCP leader Sharad Pawar from acting as president. While the HC extended the stay till December 17,it is likely to hear Pawars plea against the order on December 13.
The city civil court on November 26 temporarily restrained Pawar from acting as the president of the MCA following a suit filed by BJP leader Gopinath Munde. The court,however,stayed its order,granting Pawar time to move High Court.
Counsels for Pawar and Munde told HC that though the case before the subordinate court was reserved for orders on November 12,only the operative part of the order was made available on November 26. Hence,it was difficult for both parties to make their submissions.
Justice Anoop Mohta noted that it would be difficult for the High Court to judge the case without the reasoned order of the city civil court.
On October 18,Pawar was elected MCA president unopposed as Mundes nomination for president of the MCA was rejected on the grounds that he was not a voter registered in Mumbai. Munde termed the rejection of his nomination illegal. His lawyer Vivekanand Gupta had argued that Pawar,a registered voter in Pune,knew of the internal functioning of MCA and changed his address to that of Mumbai before the election date was announced.
Gupta said they received the lower court order on Monday evening.
