Union Minister for Environment and Forests Jairam Ramesh said Harsiddhi Heights apartments in Worli was the first structure to be served a notice under Section (5) of the Environment Protection Act for violation of CRZ 1991 norms.
Announcing the new CRZ notifications in January 2011,Ramesh had said the MoEF would be issuing a directive to all state governments under Section (5) of the Environment Protection Act to identify all violations under CRZ 1991 within four months and to initiate action.
He said Maharashtra had taken seriously the violations under section (5) of EPA and assured that the list of all violators and violations would be put on the website by December this year. Ramesh said the first notice had been issued on March 30 by the Maharashtra Coastal Zone Management Authority (MCZMA) to the co-operative housing society-Harsiddhi Heights.
The state officials said the society had been asked to explain why CRZ clearances were not taken and why the power and water supply to the society should not be disconnected. Ramesh said: CRZ violations are quiet endemic to Mumbai. We need to think of an intelligent way to deal with them and the people who have violated.
The Western Naval Command had moved the Bombay High Court against Harsiddhi Heights in October last year stating that the structure, within 300 metres of the naval base INS Trata, had not obtained a no-objection certificate (NOC) from it. The Bombay High Court has warned that it would order the demolition of the building if it finds that it has been built without the necessary permissions.
