Gawli’s brother moves High Court to visit native place

Gangster-turned-politician Arun Gawli’s brother Vijay Ahire has moved the Bombay High Court seeking permission to visit his native place and other religious places in the state. He is currently on bail and was directed not to leave the city.

Vacation judge,Justice S J Kathawala has directed Ahir to furnish details of the places he wants to visit. The case is to be heard after the vacation as the court observed there was no urgency in the matter.

Ahir was released on bail by the HC in February this year against cash bail of Rs 50,000. The court had directed him to attend the police station concerned and asked him not to leave the city.

His counsel had argued that a person cannot be arrested twice in the same case,even though MCOCA is invoked at a later stage,without following due process of law.

Ahir was booked under the stringent MCOCA for alleged extortion and organized crime syndicate activities last year. He was arrested for allegedly threatening a central Mumbai-based builder in March last year. Gawli was also arrested in this case a few days later.

Ahir had contended that MCOCA cannot be slapped on him as it requires the filing of at least two charge sheets.

The state however had contended that multiple charge sheets against the syndicate were enough and there was no need to charge sheet them individually.
