File response to MoD plea,HC tells state,housing society

Bombay High Court Monday directed the state government and the Adarsh Co-operative Housing Society to file their say in a suit by the ministry of defence

Bombay High Court Monday directed the state government and the Adarsh Co-operative Housing Society to file their say in a suit by the ministry of defence (MoD) seeking claim on the land on which the society building stands.

Justice S J Kathawala told the state and the society to file their written submissions in eight weeks and listed the case for hearing on October 8.

In December 2012,the MoD had filed a title suit stating that the land in Colaba belongs to it and it should,therefore,be granted possession of the plot. The ministry filed the suit following the findings of the state-appointed judicial panel in April 2012,that the land belonged to the state government and was not reserved for Kargil war widows or their families.

The MoD had relied on maps and documents to show the land was in existence before 1937 and was in the defence department’s possession.

The state government argued that the land was reclaimed in the 1970s and all reclaimed land belonged to the state government according to the Maharashtra Land Revenue Code.
