Expunge judge remarks,says sacked lawyer

Lawyer Anjali Waghmare,sacked as Ajmal Kasab’s counsel before his trial for 26/11 began,has moved the Bombay High Court.

Lawyer Anjali Waghmare,sacked as Ajmal Kasab’s counsel before his trial for 26/11 began,has moved the Bombay High Court seeking that the remarks the sessions judge had made in the removal order be expunged as these could hamper her professional career.

Waghmare had been the first lawyer appointed to defend Kasab but was abruptly removed after the sessions court found she was also representing Harishchandra Shrivardhankar,one of those injured during the 26/11 attack. Shrivardhankar,who was seeking compensation higher than the state had decided,had be injured allegedly by Kasab himself and his accomplice Abu Ismail.

In his order removing Waghmare,Judge M L Tahaliyani had said,“On several occasions I had asked you about it but you kept the court in the dark. I personally met the legal aid lawyers and your appointment for the victim was well before that but you did not tell us. Free legal aid is not charity,but part of court and a fundamental right of the accused under the Criminal Procedure Code. Obviously the interests of the victim and the accused clash with each other. Thus it will be appropriate to revoke your appointment. The onus of representing is more as the accused is a foreigner and under the Indian Constitution equal rights are given to them. But if found vitiated even by small extent by non-disclosure of facts then it is right to revoke her appointment.”

Waghmare’s petition came up Tuesday before Justice V K Tahilramani who adjourned it till October 14,as Waghmare’s counsel was not present.
