Defect liability period for rehab buildings revised to 10 years
The defect liability period refers to the time period in a contract during which a contractor is legally required to return to a construction site to repair any defects which appeared in that contractor's work since the date of the structure's completion.

The Slum Rehabilitation Authority (SRA) has increased the defect liability period from 3 years to 10 years for the rehab buildings, which will be taken care off by the developer, an official said.
The defect liability period refers to the time period in a contract during which a contractor is legally required to return to a construction site to repair any defects which appeared in that contractor’s work since the date of the structure’s completion.
A circular regarding the same was also issued on February 21.
“The developer (of the building) shall be held liable for any repairs/rectification required in the defect liability period of 10 years from the date that the occupation certificate is granted, except in cases of calamities, damages due to war. In the rehab building/rehab portion of composite Building for which Bank guarantee & deposits of the developer shall be withheld with SRA,” the circular read.
The decision to extend the defect liability period was made following an enquiry into a fire incident at the Jai Bhavani SRA building in Goregaon, which resulted in seven fatalities. The SRA clarified that the construction company, professionals, contractors, and subcontractors involved will be held accountable for any structural flaws or defects in buildings with a build-up area of 750 square metres or more.
With this revised extension, the society’s corpus funds can now be used for fire audits and other important activities to maintain the Slum Rehabilitation buildings, said an official. Currently the SRA charges Rs 20,000 per tenement from a developer, which is deposited in the society’s account as corpus fund after the occupancy certificate is issued for the maintenance of the building.
