Criticising the CBI for its slow pace of investigation in the Adarsh case,the Bombay High Court on Wednesday demanded to know why hard disks containing important evidence have not yet been sent for examination.
The Division Bench of Justice Ranjana Desai and Justice Ranjit More made this remark after CBI Counsel D N Salvi told the court that the hard disks are yet to be sent to the Forensic Science Laboratory (FSL) in Hyderabad.
If the hard disks were seized a month earlier,there is no reason why the investigating agency has not sent them to the laboratory at Hyderabad. If the delay is on the part of the laboratory,then it is a different matter. But here,the investigating agency itself is responsible for the delay. That is why you could not file the chargesheet in time, Justice Desai said.
The hard disks,which,according to the CBI,contain notesheets on the Adarsh Society,had been seized from the Urban Development Department in Mantralaya.
The counsel for the CBI said that it would send the disks within a week.
Criticising the investigating agency,Justice Desai said,You need to do the investigations properly and get results. The responsibility should not be on just one or two persons. One can understand some delay due to overburdening of the investigating officials. But now these reasons cannot be accepted. The judges have asked the counsel for the CBI to file a status report by September 5.
