Cops to record statement of teen accused in presence of magistrate

The police have booked Kumar for unnatural sex under the Indian Penal Code and the Protection of Children from Sexual Offences Act.

In an attempt to build a watertight case against the teenager arrested earlier this week for allegedly sexually assaulting an infant, the Wadala TT police will  record his confession in the presence of a magistrate.

The accused, Suresh Kumar (19), was arrested on March 15 for allegedly assaulting his neighbour’s 11-month-old son at his residence in Wadala. The police said he had taken the victim to his residence with permission to play with the child, and returned him around 40 minutes later.

When the victim did not stop crying for a while, his mother took him to a local clinic and doctors confirmed that he had been a victim of unnatural sex, after which she approached the police, and Kumar was arrested.

According to the Wadala TT police, owing to the age of the victim, they would rely on medical evidence, the confession of the accused and statements from other witnesses in the case.

“We will soon record Kumar’s confession in the presence of a magistrate in accordance with the provisions of Section 164 of the Criminal Procedure Code (CrPC). The victim is out of danger and will be discharged from the hospital in a couple of days, after which we will also record his mother’s statement,” said Senior Police Inspector Suhas Garud, Wadala TT police station.

Garud added that apart from the victim’s mother, the statement of another witness, a neighbour of the family, would also be recorded.

“The witness saw Kumar leave his house with the victim around 11.40 am on March 15, and even asked Kumar why the child was crying so uncontrolably,” said Garud. The police have booked Kumar for unnatural sex under the Indian Penal Code, as well as under the Protection of Children from Sexual Offences Act.
