In A case where the father of a 15-year-old boy had alleged that his son died in August last year due to negligence of doctors of the Chhatrapati Shivaji Maharaj Hospital, Thane, the Maharashtra State Commission for Protection of Child Rights (MSCPCR) has ruled that the boy “died due to malaria and not by the removal of blood and organs”. The order relased recently cited, “Negligence at the level of the doctors has not been established”.
The father had claimed that the boy died after blood was transfused from his body by the doctors. The applicant had also claimed that the post-mortem report was not given to them and when they asked for it, the family was beaten by the police. He also alleged that his son was “murdered by the doctors with the help of unknown people, thus criminal conspiracy in the matter could not be ruled out”.
The report filed by the medical superintendent of the hospital said appropriate treatment was given to the boy. “The medical history of the patient showed that he was suffering from malaria and thrombocytopenia (relative decrease of platelets in blood). All necessary treatment was given to the patient under medical supervision, but he was not responding to it. There was total loss of vital signs and later he was pronounced dead. To ascertain the exact cause of the death, it was decided to conduct a post-mortem examination,” the report read.
In their final order, MSCPCR said that the post-mortem report revealed that the death of the patient was due to malaria.
“Allegation raised by the complainant against the police regarding the assault on family members of the complainant has also not been established,” the commission ruled.
