The Aurangabad bench of the Bombay High Court recently directed District Superintendent of Police, Chhatrapati Sambhajinagar to conduct expeditious inquiry into whether any foul play resulted in grant of medical certificates by a particular hospital to several prisoners who sought parole on medical grounds.
The Court asked the Police to see how frequently certificates are issued and what is the connection since only one hospital is issuing such certificates. The court was hearing a plea by a murder convict against an order of prison authorities that rejected his application for extension of parole to cater to urgent medical needs of his wife based on a certificate of the said hospital.
A division bench of Justices Vibha V Kankanwadi and Justice Santosh G Chapalgaonkar on September 9 hearing criminal writ petition by one Kundan Suresh Pardeshi, serving life imprisonment, who had initially been granted a 30-day parole by HC from July 27, this year for his own wedding
During the parole leave period, he had filed an application for extension of the parole on August 21, citing that she was experiencing complications during the pregnancy and there was a need for cervical cerclage procedure.However, the said application was rejected by authorities on August 28 questioning lack of clarity in the documents, prompting him to approach the HC. Advocate Sharda P Chate for the petitioner submitted that authorities of Nashik district hospital were not ready to give certificate. The bench said it was not convinced with the said documents.
The bench also questioned that while the wife of the petitioner appeared to be resident of Nashik, he provided a certificate stating that she had taken treatment at one Eagle Multispeciality Hospital, Ranjangaon, in Gangapur Taluka of Sambhajinagar district in May, 2024.
“It will not be out of place to mention here that while dealing with the parole applications in recent times, we have come across that the inmates are bringing certificates issued by this particular hospital i.e. ‘Eagle Multispeciality Hospital, Ranjangaon.’ Especially in today’s matter, the certificate is issued by Dr. Suraj S. Rana, who appears to be an accused in crime registered with Pundlik Nagar Police Station, District-Aurangabad, for the offence punishable under Sections 120-B, 314, 203, and 201 of the Indian Penal Code,” the Court noted.
Therefore, the court said it was required to order the probe either by SP or through a responsible high rank officer within 15 days .”Since we are not believing in the said certificate, we reject the prayers in the Writ Petition,” it held and said it will peruse inquiry report and pass further directions on September 23
