The Bombay High Court on Monday gave go-ahead for the construction of a carshed at Kanjur village for Metro 6. The court said that the project is concerned with public interest with a view to provide transport facility to the public in general.

The MMRDA had submitted that 34 non-mangrove trees will be affected, and some forest land will be required to be diverted, for which requisite permissions have been obtained. It was also submitted that compensatory afforestation will be undertaken, and a 0.10 hectare has been earmarked at Manori.

A division bench of Chief Justice Alok Aradhe and Justice Sandeep Marne said that MMRDA give an undertaking on adherence of the conditions.

The MMRDA had approached the high court seeking directions to the Union Ministry of Environment, Forest and Climate Change to carry out work of Metro Line 6 to commence construction of Metro piers at Kanjur village. Permissions were granted by Maharashtra Coastal Zonal Management Authority (MCZMA) and the State Environment Impact Assessment Authority, with a condition that the high court find the project ‘necessary and expedient’ for public interest.

The MMRDA through its advocate Akshay Shinde had said the Metro Line 6 passes through a mangrove forest. Also, 1.0 hectare of the proposed Metro carshed at Kanjurmarg, spread over 15.02 hectares, falls in Coastal Zone Regulation -II. The MMRDA had submitted that the requirement for mangrove forest land is ‘unavoidable’ with a ‘bare minimum requirement’.

The court noted that the expert bodies had considered the issues while granting permissions. The Metro 6 will run between Swami Samarth Nagar in Andheri to Vikhroli.
