In the detailed order rejecting bail to an accused in the Salman Khan house firing case, a special court said the applicant played an active role in the crime and was intentionally involved  in organised crime activities.

On Monday, the court rejected the bail plea of Mohammed Rafique Sardar Chaudhary. The allegations against him are that he had done a recce outside Khan’s Bandra residence, Galaxy Apartment, shot a video and sent it to a co-accused. A firing had taken place on April 14, 2024, outside Galaxy Apartment.

The court referred to the confessional statement of the accused stating that it showed that he was in touch with the co-accused. “The confessional statement of the present applicant also reflects that the applicant is continuously having  contact with the co-accused. He was asked to leave Mumbai after the incident. Accordingly,  he left the Mumbai and went to Rajasthan. This fact also shows mens rea of the applicant behind the crime,” the court said.

Chaudhary had submitted that no such data was recovered to show that a video was sent. He also said that a video taken of a public place does not show that he had any knowledge, intent or motive to commit the crime. He also raised the issue of the delay in filing of the FIR and said that the charge under Section 307(attempt to murder) of the IPC cannot be invoked as Khan’s statement does not show that firing was done at him.

Chaudhary had also said that he had no criminal antecedents and that he was not part of the organised crime syndicate and he had already spent 14 months in jail with the trial yet to start.

The court said that the accused had been given Rs 8,000, stating that this showed monetary gain.
