UP: 21-yr-old woman gets jail for false testimony in kidnapping & rape case

A COURT in Bareilly on Saturday sentenced a 21-year-old woman for giving a false testimony in a kidnapping and rape case registered in 2019. The duration of her sentence – four years, eight months, and six days – is the same as the time that a 25-year-old man implicated in the case served in prison.
The court also imposed a fine of Rs 5.88 lakh on the woman, with the provision that failure to pay would result in an additional six months of imprisonment. The court directed that the amount be paid to the man who was implicated in the case.
This fine, amounting to Rs 5,88,822.47, was determined on the basis of daily wages set by the Uttar Pradesh government for unskilled labour, said government counsel Sunil Pandey.
Government counsel Sunil Pandey said, “During the trial, the woman backtracked on her earlier statement during cross-examination. She denied the assertion that the youth kidnapped and raped her. She was then arrested and sent to jail.”
“Later, woman was released on bail. Last month, the court acquitted the 25-year-old man due to lack of evidence,” added Pandey. The court convicted the woman under IPC section 195 (giving or fabricating false evidence with intent to procure conviction of an offence).
The court order read, “In this case, she is punished with rigorous imprisonment of 04 years, 06 months, 08 days i.e. 1,653 days and a fine of Rs 5,88,822.47/-, in case of non-payment of fine, she will have to undergo simple imprisonment for additional 6 months.” The man was behind bars from September 30, 2019, to April 8 this year.
