The CBI on Friday filed the chargesheet in the case of murder of Balipur pradhan Nanhey Yadav against five accused, including former minister Raghuraj Pratap Singh alias Raja Bhaiyya’s driver Sanjay Pratap Singh alias Guddu Singh, his brother Rajeev alias Raju and three others.

The CBI has booked the accused on charges of murder, conspiracy and Arms Act. The court has fixed June 7 for taking cognizance of the chargesheet.

The chargesheet was filed in CBI court of special judicial magistrate Mirza Zeenat. Investigating officer Subhash Kundu submitted 62 documents and statements of 81 witnesses to substantiate the charges.

Of the five accused Guddu,Rajeev and Kamta’s sons Ajay and Vijay are lodged in jail while their relative Rakesh Narayan Pal has not been arrested so far.

While Ajay and Vijay are accused of executing the murder of the former pradhan,Guddu and Rajeev face charges of conspiracy. Rakesh is booked under the Arms Act,as the agency had recovered the murder weapons from his house, sources said.

Nanhey’s murder on March 2 had sparked a chain of events which led to the murder of his brother Suresh and Kunda DSP Ziaul Haque later the same night. The CBI is investigating all three murder and this is the first chargesheet it has filed.

The CBI investigation found there was an old rivalry between the pradhan and Guddu, which led to murder. The agency has also found that Nanhey and Guddu, both, were supporters of Raja Bhaiyya.

During investigation, the agency came across the fact that there were two groups at Balipur village, led by Nanhey and Guddu. Kamta, who was political rival of Nanhey, belongs to Guddu’s group.

In 2005,Kamta had defeated Nanhey in the panchayat elections and become pradhan. Later,in 2010 elections,Guddu asked Nanhey not to contest against Kamta and let him continue in the next term. But,Nanhey did not agree and defeated Kamta.

A matter engaged both the groups in a fresh dispute. It was related to 10 biswa land purchased by Guddu’s associate Raj Kumar Saroj at Balipur village in April-May 2012. Nanhey’s associate Lalla Patel claimed ownership of the same land which led to a dispute between the two groups and Guddu and Kamta started arranging meetings between Lalla and Raj Kumar to settle the issue.

Nanhey took the issue seriously and he,accompanied by his brothers Phoolchand and Suresh, assaulted Kamta mercilessly at Balipur crossing on February 25.

Kamta’s son Ajay complained to Guddu about the assault on his father. Guddu talked to then station officer (SO) of Hathigawan police station Manoj Kumar Shukla asking him to initiate action against the pradhan and his brothers for beating up Kamta. However, the SO did not take any action.

On February 25,Guddu,his brother Rajeev and Kamta’s sons Ajay and Vijay hatched a conspiracy to kill the pradhan. Guddu assured Kamta’s sons of all help, and they arranged country-made weapons for the murder.

On March 2,as per CBI investigation,Nanhey was chatting with four labourers at Balipur crossing when Ajay and Vijay arrived there on a motorcycle. They fired at the pradhan causing his death and escaped.

Soon after the shootout,Ajay called up Rajeev and informed him about the murder. Rajeev immediately called up Guddu, who was in Lucknow, and passed on the information.

Ajay and Vijay went to their relative Rakesh’s house at Katra Bazar village in Pratpagrah and spent the night there. They left the place next day and kept the murder weapons with Rakesh, the investigation confirmed.

Guddu and Rajeev were arrested on March 4 while Ajay and Vijay were arrested on April 7. The CBI had also recovered two .315 bore country-made firearms used in the crime the same day.
