Former UP Minister Amarmani Tripathi (Express Photo by Prem Nath Pandey)THE Allahabad High Court on Friday rejected a petition filed by former minister Amarmani Tripathi seeking direction to stay the proceedings of the Basti court, which had ordered the attachment of his properties in a 2001 kidnapping case after he remained absconding.
Earlier this month, the court had directed the UP Principal Secretary (Home) and Director General of Police (DGP) to take necessary steps for attaching the properties of the former minister.
In its order passed on Friday, Justice Sanjay Kumar Singh stated: “The application lacks merit and is accordingly rejected. However, it goes without saying that in case the applicant appears and applies for regular bail, the same shall be decided on the same day in the light of the judgment of the Apex Court in the case of Satender Kumar Antil Vs CBI and Another, (2021) 10 SCC 773.”
On August 24, the state government ordered premature release of Tripathi, a four-time former MLA, and his wife Madhumani, who is serving life imprisonment in the 2003 murder case of poet Madhumani Shukla. The government then said Tripathi and his wife showed “good behaviour while serving the term”.
According to the prosecution, in December 2001, businessman Dharam Raj Maddheshiya’s son Rahul was allegedly kidnapped from near his house in Basti. Police found Rahul purportedly locked up in a house under Tripathi’s possession.
