The Allahabad High Court on Monday dismissed the petition of a student seeking re-evaluation of physics paper in UP Boards Intermediate Examination-2011 saying the paper was checked minutely and award of zero marks in some of the descriptive questions was not a matter of surprise.
The decision has left the future of the petitioner,Aneet Kumar Verma,son of Lal Chand Verma,a farm labourer from Azamgarh,in lurch as he has passed two state-level engineering entrance examinations but may not get admission because his results will show him fail in one subject in the Intermediate exam.
Dismissing the petition,single -judge bench of Justice V K Shukla,said: Perusal of the answersheet (of paper-I) reflects that whatever questions were attempted by the petitioner,they have been checked minutely and marks have been awarded against the same. In case performance is so much poor and the circumstance so demands,zero mark can be awarded. It may not be a matter of surprise.
Incidentally,had Aneet got two more marks,he could have been in a position to be declared passed with grace marks. Aneet had scored 316 marks in the rest of his four papers,with an aggregate of 63 per cent. However,he failed in physics obtaining only 45 marks,out of which 30 were for practicals.
Referring to the option of going in appeal against the court order,Aneets counsel,Ram Surat Saroj,said the petitioners father was too poor to go through the litigation process.
During a previous hearing,the court had directed the governments counsel to produce Vermas answersheets of both the papers – I and II – of Physics. However,till date,only one answersheet has been produced.
In his petition,Aneet,a student of S K G Inter-College at Lalganj in Azamgarh,had maintained that his answersheet was not checked properly.
In the first paper of Physics,Verma had scored nine marks,while in the second,it was only six. Thus,he got a total of 15 marks in theory and together with 30 out of 30 in practical,his total marks in the subject stood at 45.
Saroj said Aneet had scored 83 in Hindi,67 in English,58 each in Maths and Chemistry,and 45 in Physics. He has cleared engineering entrance tests for Mahamaya Technical University and UP State Entrance Examination.
