A Budaun court on Thursday issued a non-bailable warrant (NBW) against local BSP MLA Yogendra Sagar in a case of alleged gangrape in 2008. The warrant was issued following directive of the Lucknow bench of Allahabad High Court.
The Budaun SSP,DK Chaudhary,told The Indian Express that they have received the NBW and the Station Officer (SO) of concerned Bilsi police station has been ordered to comply with the courts order. The MLA would be arrested and the police would attach his property if he is found absconding,he said.
The victims lawyer,Kshitij Shankhdhar,said the division bench comprising Justice Abdul Mateen and Justice Ashwani Kumar Singh had ordered the Judicial Magistrate (JM)-I of Budaun,who is the presiding officer in the case,on March 15 to issue an NBW against the MLA. The order was received at the Budaun court on Thursday.
Since the JM was not present today,link officer Additional Munsif Magistrate Mirza Zeenat issued the NBW following the HCs order,Shankhdhar added.
Sagar,an MLA from Bilsi constituency,had earlier procured a stay from the HC against his arrest after the Budaun court had issued the NBW earlier.
A petition was filed before the HC after the police did not arrest the MLA even after the stay was not extended beyond January 1.
On May 1,2008,a case under section 366 (kidnapping,abducting or inducing woman to compel her marriage) of the IPC was lodged by Kuldip Sharma alleging that his 24-year-old daughter had been abducted. The girl was recovered later from Muzaffarnagar district. She had later stated before the court that she was kidnapped and raped by Sagar,his brother Tejendra Sagar and an associate Meenu Sharma. Sharma and Tejendra are presently lodged in Badaun jail.
