Cop slapped by MLA moves court

After waiting for a month for the state government to take action against Haji Yakub Qureshi,BSP MLA from Meerut city who had slapped him in public,constable Chahan Singh Balyan (56) of the UP police has filed an application in the court,seeking registration of a criminal case against the MLA.

Chief Judicial Magistrate V P Verma has listed the case for March 24.

Constable Balyan moved the court on March 17,exactly a month after the incident which took place when he tried to divert the MLA’s cavalcade away from the route of a procession. Balyan said he moved the court when he noticed the local police was not showing interest in taking action on his complaint that he had submitted immediately after the incident.

A day after the incident,Meerut DIG JN Singh said he had ordered an inquiry into the incident by SP (City) Prabal Pratap Singh. The SP (City) said the inquiry is still on.

Balyan said whosoever was conducting the inquiry had not spoken to him so far.

His advocate V K Gupta said,“We have told the court that the constable,who is a public servant,was assigned duty to not allow any vehicle on the route of the procession. He was publicly abused and beaten when he stopped the MLA’s cavalcade.”

Gupta said they had also informed the court that following his humiliation,the constable developed angina pain and had to remain in the hospital for three days. The medical report of constable has been attached with the complaint.

“We have told the court that a case under various sections of the IPC,including voluntarily causing grievous hurt to deter a public servant from his duty,should be lodged against the MLA. The court has asked the local police to file a reply and fixed March 24 as the next date,” added Gupta.

Station Officer of Lisarigate Om Prakash said they had sent a report to the court.

Recalling the incident,Balyan said the incident happened when he,along with some other constables,was deployed at the Hapur Adda crossing in view of the Ravidas Jayanti procession. Around 7 pm,a jeep without a number plate and with a double hooter,arrived. One of the men told the jeep driver that no vehicle was allowed to go on Brahampuri road in view of the procession.

The jeep driver abused the man for daring to stop him and told him that the vehicle belonged to the MLA who was following in a SUV. Balyan,who was also present,told the driver to behave and switch off the hooter.

In the meanttme,the MLA’s SUV arrived. From inside,the MLA started hurling abuses at Balyan for stopping the vehicle and asking that the hooter be switched off.

Balyan told him that his instructions were not to allow any vehicle on Brahampuri road.

An angry MLA got off the car,caught Balyan by the collar and slapped him. His men from two other vehicles also thrashed the constable and tore his uniform.

Other constables and locals intervened and requested the MLA to spare the constable. Balyan then informed about the incident to SP (City) who advised him to come to his office. There,Balyan gave him a complaint and returned home. The next morning,Balyan developed chest pain soon after he went to work and had to be rushed to a hospital.
