TO ENSURE stringent action against “solver” gangs and people involved in leakage of question papers of public examinations, the Uttar Pradesh State Law Commission (UPSLC) has prepared a draft bill: Uttar Pradesh Public Examination (Prevention of Unfair Means, Paper-Leak and Solver Gang Activities) Bill, 2023.
The move is aimed at ensuring fairness in public examinations, official sources said on Saturday. The draft bill has a provision for imprisonment of not less than five years and fine of Rs 10 lakh, which may extend up to 14 years and a fine of Rs 25 lakh.
There is also a provision to attach property, of any person operating as a member of solver gang, singularly or in public, that was acquired by committing an offence. The Commission submitted the draft bill to the government recently, sources said.
For preparing the draft bill, the state law commission undertook critical study of laws prevalent in the state and other states of the country for prevention of unfair activities in public
examinations.
After taking all aspects of public examinations into consideration, the law commission decided to prepare a draft for an effective law to curb menace of paper leakage, copying and solver gang activities in public examination and submit the same to the state government for enacting with adequate penal provisions. The law commission had taken suo motu cognizance of menace prevailing in the society because of “solver” gangs and use of unfair means in public
examination.
In the past, several states have enacted a law to curb cheating and use of unfair means during public examinations.
When contacted on Saturday, UPSLC Chairman Justice (retired) Pradeep Kumar Srivastava said the commission had focused on “solver” gangs and people involved in paper leakage.
Before preparing the draft bill, the law commission studied news reports on such gangs and paper leaks and also Acts in several states as Jammu & Kashmir, Rajasthan, Andhra Pradesh, Chhattisgarh and Haryana.
The commission also went through the Uttarakhand Competitive Examination (Measures for Prevention and Prevention of Unfair Means in Recruitment) Ordinance 2023, promulgated by the Uttarakhand government recently.
