The amicus curae,appointed by the Calcutta High Court in connection with the PILs seeking the CBI probe into Saradha Group chit fund scam,on Tuesday told the Division Bench of Justice Ashim Kumar Banerjee and Justice Mrinal Kanti Chaudhuri that the state governments probe should continue and there was no need of any investigation by the central agency.
Lakhi Gupta,the amicus curae,said there was no specific allegation against the state administrations inquiry. Considering the impartiality and fairness of the ongoing probe into the Saradha scam,the West Bengal Police should continue the probe,he added.
Discounting the need for the CBI probe into the multi-crore scam as sought by the petitioners,Gupta pointed the central agencys affidavit in which it had stated that it could carry out the investigation if the state government provided manpower and logistics.
The CBI has admitted to having inadequate infrastructure to investigate the case,and therefore there was no reason to hand over the investigation to the central agency,Gupta said.
Gupta also questioned the impartiality of the CBI and pointed to the recent observations made by the Supreme Court in connection with the probe in Coalgate scam in which the apex court had likened the central agency with a caged parrot with many masters.
Urging the court to pass a reasonable and detailed order,Gupta said the case be not disposed of and keep the matter pending so that any person aggrieved by the current probe can approach the court in future.
He also said the terms of reference of the Justice (retd) Shyamal Sen Commission set up by the state government be increased to facilitate refund of money to investors of the Saradha Group.
