The Delhi government has notified changes in labour rules to allow women to work night shifts in all professional establishments other than liquor shops. The “consent of women shall be required before employing them in night shifts”, the notification says.

The notification says that “no employee shall be employed or allowed to work for more than nine hours (including that of meal and rest) on any day and for not more than forty eight hours a week”.

Also, “no employee shall be allowed to work for more than five hours at a stretch”, and “overtime wages shall be paid to eligible employees at double the normal rate as provided under section 8 of the Delhi Shops and Establishment Act, 1954”, says the notification.

“Shift working, if any, shall be in such a way that no employee is forced to work in night shift only”, the notification says. The “employer shall make suitable arrangements regarding safety, security and transportation of all the employees, who have been asked to work overtime or in shifts beyond the normal working hours”, it says.

The notification underlines that “every employer employing women employees shall constitute lnternal Complaints Committee against sexual harassment of women under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013” to provide women workers a safer, more secure workplace.
