Umar Khalid’s plea challenging UAPA provisions: SC issues notice to Centre
Khalid had approached the SC after the Delhi High Court in October last year upheld a trial court order denying him bail in the case.

The Supreme Court Tuesday sought the Centre’s reply on UAPA accused Umar Khalid’s plea challenging some of the provisions of the anti-terror law.
Issuing notice, a bench of Justices Aniruddha Bose and Bela M Trivedi also decided to hear his bail plea in connection with the February 2020 Northeast Delhi communal riots along with his petition challenging the UAPA provisions as “they have overlapping implications”.
Khalid had approached the SC after the Delhi High Court in October last year upheld a trial court order denying him bail in the case.
On Tuesday, the SC pointed out that there were also a few other petitions too on the subject and fixed November 22 for hearing them all.
The top court had clubbed his bail petition with the plea against UAPA earlier and fixed them for hearing on November 1. But with the fresh plea coming up today, the court after issuing notice decided to take up all of them together in November.
“We are listing the writ petition along with the special leave petition for bail because they have overlapping implications. Other connected matters also will be taken up with these since they are also challenges against Sections 15(1)(a) and 18 of the UAPA”, the bench said.
Khalid was arrested in September 2020 in connection with the Northeast Delhi riots that left 53 dead and hundreds injured. He was charged with the UAPA and the Prevention of Damage to Public Property Act, 1984.
In March 2022, the trial court rejected his bail plea. Upholding this on October 18, 2022, the Delhi HC said Khalid was in constant touch with other co-accused and the allegations against him were prima facie true. It also said that his actions prima facie qualified as a “terrorist act” under UAPA.
