Following a directive from the Delhi High Court to the Bar Council of Delhi,the HC Registrar and the Supreme Court Bar Association to form rules for curbing malpractice affecting lawyers in the Capital,the Coordination Committee of Bar Associations of Delhi has passed a resolution to set its house in order.
The resolution proposed one Bar one vote to ensure free and fair polls to various Bar Associations (BA) of Delhi. Earlier,advocates held membership of more than one association and also voted in multiple elections,affecting free and fair polls to the bodies. To stem the practice,the resolution also proposes that the BAs can have associate members along with regular members,but the former will not be eligible to vote in Bar elections.
The directive came following a writ petition by advocates in this regard.
The petition also noted that in the absence of proper rules,many advocates have more than one chamber in various court complexes,while some do not have even one. The Delhi Bar Association had also written to the High Court Chief Justice about false affidavits given by advocates to secure dual allotment of chambers,the petition said,seeking that advocates who sold or transferred their chambers should not be allotted a new chamber.
The Coordination Committee resolution said only regular members will be entitled to claim a chamber in the court complex. An advocate who has a chamber at one court complex will have to surrender it when he/she is allotted another chamber in a different complex.
District Bar Associations of Delhi President Rajeev Khosla said: The resolution is under consideration of the Bar Council of Delhi. After their approval,the matter will be submitted to the Delhi High Court for final approval. The case is scheduled in the High Court in the first week of April.
Counsel for petitioners Amar Nath Saini said: Its a positive step by the lawyers representative body,as it will help streamline functioning and provide better services to litigants.
The resolution also fixed the term of executive committee of Bar associations for two years,adding that officebearers will not be entitled to contest the same post in the next election.
There is an in-principle acceptance of these proposals among members. I have convened a meeting of Bar Council this month,the resolution is likely to get approved, said Rakesh Tiku,chairman of the Bar Council of Delhi.
