President appoints retd Allahabad HC judge as DERC chief
Delhi's ruling AAP government had earlier proposed the name of Justice (Retd) Rajeev Kumar Shrivastava of the Madhya Pradesh HC for the position.

President Droupadi Murmu has appointed Justice (Retired) Umesh Kumar of Allahabad High Court as the chairperson of the Delhi Electricity Regulatory Commission (DERC). Notably, this is also the first such order after the promulgation of the Government of National Capital Territory of Delhi (Amendment) Ordinance, 2023.
Delhi’s ruling AAP government had earlier proposed the name of Justice (Retd) Rajeev Kumar Shrivastava of the Madhya Pradesh HC for the position.
While the L-G House said Justice Kumar was appointed after Justice Shrivastava expressed his inability to take up the job, Delhi’s power minister Atishi Wednesday called the move “illegal and unconstitutional.”
She said, “The Supreme Court has repeatedly stated that on all subjects (apart from Land, Public Order and Police) the aid and advice of the elected government is binding. ‘Electricity’ is a transferred subject falling under the jurisdiction of the elected government. On 21st June, the Hon’ble Chief Minister sent a recommendation of the name of Justice (Retd) Sangeet Lodha for the post of DERC Chairperson. The President wilfully ignored and overlooked the aid and advise of the elected government.”
Meanwhile, a press note shared by the L-G house, said, “This appointment comes after Justice (Retd.) Rajeev Kumar Shrivastava of the Madhya Pradesh High Court proposed for appointment as the DERC Chairperson by the AAP Delhi government expressed his inability to be appointed as Chairperson, through a communication to the Lieutenant Governor on June 15”.
