NOC from property tax dept might be made mandatory

Those buying new properties in Delhi will need a mandatory No Objection Certificate from the property tax department,if the Delhi Government approves of it. A resolution to prevent the buyer from paying arrears on the property has been sent to the Delhi government after getting approval from the standing committee.

In the resolution placed before standing committee,assessor and collector Property tax department has put a letter sent to the secretary of department Urban Development in which it has been stated that when the purchaser approaches the corporation for mutation under section 128 of DMC Act,the mutation cannot be done unless the property tax dues including arrears are paid.

“The new owner has to bear the financial burden which should have been paid by the seller. Obtaining NOC from property tax department at the time of registration of Transfer Deeds save the purchaser from difficulties and additional financial burden,” stated the letter. The property tax is to be recovered from self-occupied residential properties in villages if it covers more than 200 sqmtrs,though villages are exempt from property tax.

Requirement of NOC from property tax department of corporation at time of re-registration of sale or purchase or GPA is not mandatory yet as per Registration Act or Stamp duty Act,though resoltion for amendment in act has been sent.
