The Delhi High Court on Friday asked the Uttar Pradesh governments Home Secretary to appear before it on December 14 in a case if the government fails to file its objections,if any,to the transfer of investigations into the death of Sahibabad girl Monika Dagar from the state police to the CBI.
Dagar had married Gaurav Saini in July this year against her familys wishes. The couple lived together for a while in Delhi,until the UP Police tracked them down and arrested Saini for allegedly kidnapping Dagar,after a complaint filed by her family.
After a month in jail,Saini came out on August 11 and approached the Delhi High Court to know the whereabouts of his wife.
The court had directed UP Police on September 16 to produce Dagar in court. Dagar,however,died under mysterious circumstances at her family home the same day the court order came.
The Delhi High Court had,in the previous hearing,pulled up Ghaziabad police for bungling investigations in the case,leading to her husbands arrest and her suspicious death in her paternal home.
A Bench headed by Justices S K Kaul and Justice Ajit Bharihoke had,on the previous date,also sought responses from the UP Police and the Home Secretary on why a case of murder was not framed against the girls family as prima facie evidence pointed to honour killing.
The police informed the court that a case has already been registered against nine persons,including Dagars mother Yashoda Devi and brother Nitin.
The court has now sought a written response from the UP Government as to why the matter should not be probed by the CBI by the next date of hearing,December 14.
