“He (victim of the accident) must have suffered immense physical, mental and emotional trauma for what he was compelled to undergo on account of injuries sustained in the accident,” said Presiding Officer Shelly Arora in her order dated October 17.
She was hearing a petition seeking compensation filed by Prashant Joshi, who was injured after a speeding car collided with his two-wheeler on April 3, 2019. Joshi was on his way from Mayur Vihar to his home in Ghaziabad.
An FIR was registered at the Indirapuram police station and a chargesheet was subsequently filed against the driver for rash and negligent driving.
“There is no measure with the court to quantify the pain and suffering of the injured; however, an attempt is being made to compensate in terms of money for the agony he must have suffered,” the Tribunal said.
While granting monetary compensation to Joshi, the court said that it looked at factors such as damages for pain, suffering and trauma on account of injuries, loss of future earnings, cost of medical attendant, medical treatment, conveyance cost and loss of amenities of life.
Joshi had suffered multiple fractures in both legs, which led to 65% permanent physical impairment. The court directed the insurance company to deposit the compensation.
“The disability certificate on record shows that he has suffered 65% permanent physical impairment in relation to both lower limbs. This impairment directly affects his mobility and daily functioning,” the tribunal said.
“With both legs involved, he would face serious difficulty in walking, standing for long periods, climbing stairs, or driving. Even his routine activities are restricted, which in turn affects his ability to work and earn,” it added.
