HC seeks report on medical condition of former PFI chief E Abubacker

A division bench issued notice to the National Investigation Agency (NIA) in a fresh plea moved by PFI chairman Abubacker seeking implementation of an order of a special court directing his admission in AIIMS.

The Delhi High Court on Monday directed the medical superintendent, Tihar jail, to file a report on the ‘medical condition’ of former Popular Front of India (PFI) chief E Abubacker and treatment provided to him at the All India Institute of Medical Sciences (AIIMS).

A division bench of Justice Siddharth Mridul and Justice Anish Dayal issued notice to the National Investigation Agency (NIA) in a fresh plea moved by Abubacker seeking implementation of an order of a special court directing his admission in AIIMS.

The bench said, “Medical Superintendent is directed to furnish a report on the current medical condition of the appellant (Abubacker) and the treatment being provided by AIIMS.” The matter is next listed for September 20.

Abubacker had moved the HC last year seeking interim bail on medical grounds against a November 14, 2022 order of the special court (NIA). The HC had directed the medical superintendent, Tihar Jail, to ensure that Abubacker is provided with “efficacious treatment” for his illnesses. The plea was subsequently withdrawn by him with liberty to approach the special court.

Abubacker was arrested by the NIA on September 22, 2022 during the nationwide crackdown on the now-banned organisation, PFI, and is presently in judicial custody. The agency has booked Abubacker under Sections 120B and 153A of Indian Penal Code (IPC), and various provisions of the Unlawful Activities (Prevention) Act.

In December last year, the HC had refused Abubacker’s request for “house arrest”, but had allowed his son to remain present in case his father was to be provided with consultation and treatment by AIIMS hospital’s onco-surgery department, if advised by the consulting or treating doctor.
