A Gurgaon court has ordered police to register an FIR against Unitech Realty Pvt Ltd and open a probe in an alleged multi-crore fraud case.
The court ordered the Station House Officer (SHO) of Sadar police station to register the case under sections of cheating, preparing and using fake documents and criminal conspiracy (Sections 420, 467, 468, 471 and 120-B of IPC).
The order came on a complaint by nearly 900 people, who have booked flats in Unitech Realty Pvt Ltd’s group housing project at Sector-47 in Fatehpur village, Gurgaon. The project — worth Rs 400 crore — comprises 896 apartments, including 158 EWS flats, along with a club, nursery school and other amenities.
According to the complaint petition filed by one Amit Gupta, the project was officially launched in 2008 after all necessary approvals from the Haryana Urban Development Authority (HUDA) and director, Town and Country Planning.
The houses were to be handed over to owners, who have made 95 per cent of the payment, by September 2011. But according to the complainants, in a recent letter to the allottees, Unitech Realty has said land around the project that marks the entry and exit roads have been encroached and the project cannot be completed unless the encroachments are cleared.
An RTI filed by the complainant for the demarcation plan of Sector-47 that was prepared in 2000 revealed that the road was under illegal encroachment at that time too and was not a demarcated area.
The court said in its order, “In view of the facts and circumstances of the case, the complaint is sent to concerned police station under Section 156(3) Criminal Procedure Code (CrPC) for registration of FIR.”
