Employer of Vasant Kunj help denied bail,to be counselled

Dorothy was arrested on October 3 and sent to judicial custody on October 4.

A city court on Monday dismissed the bail plea of Vandana Dhir,the 50-year-old woman accused of torturing her help in Vasant Kunj,and directed the jail authorities to provide “psychoanalysis,therapy and counselling” for .

The bail application was dismissed on the grounds of extreme torture inflicted on the help,the results of the investigation which stood against Dhir and the fact that there was no evidence to back all the counter-allegations made by Dhir against the maid. Other reasons cited for denying bail were Dhir’s socio-economic position allowing her to tamper with the evidence or influence the witness and investigation.

Though the court attributed the alleged ill-treatment of the help to Dhir’s “sick and problematic” mental condition and “personality disorder”,it also took note that she had been condemned by society. According to sources,Dhir had been placed under suspension after she was arrested in the case. “…it would be desirable if her employers may re-consider their decision of putting her under suspension,as the same would be in sync with the rehabilitative and reformative approach of law,” the court held.

In her order,Metropolitan Magistrate Gomati Manocha also called for an institution and a legislation to regulate the functioning of placement agencies which provide domestic helps,mentioning that they have turned into “havens of exploitation”.

“A legislation is much-needed,requiring mandatory registration of the placement agencies,payment of minimum wages to workers,decent living conditions,diet,security and protection against physical or sexual abuse or exploitation,” the order mentioned.

The court also remanded Dorothy,the owner of the placement agency that had placed the help with Dhir,in police custody for a day. Dorothy was arrested on October 3 and sent to judicial custody on October 4. She was sent to custody to allow police to confront her with the help’s mother and to affirm whether she had paid the mother for the help’s services.

Police also intend to question Dorothy about the whereabouts of Kajal,the help who used to work in Dhir’s house earlier.
