‘Delhi govt working like a headless body’: Law student files PIL seeking ‘extraordinary interim bail’ for CM Kejriwal

The plea seeks interim bail in all cases -- including the ones registered by the Enforcement Directorate -- which are pending inquiry or trial, till the completion of his tenure or till the completion of the trials, whichever ends earlier.

Claiming that the Delhi government and its administration are working like a “headless organisation”, a fourth-year law student has filed a PIL in the Delhi High Court seeking “extraordinary interim bail” for Chief Minister Arvind Kejriwal in all criminal cases registered against him.

The PIL has been moved by the student under the title, ‘We, the People of India’, stating that he has used this title because he does not want any fame, gain or money. The matter has been listed on April 22 before a bench led by Acting Chief Justice Manmohan.

The plea seeks interim bail in all cases — including the ones registered by the Enforcement Directorate — which are pending inquiry or trial, till the completion of his tenure or till the completion of the trials, whichever ends earlier.

It claims that since the CM’s arrest on March 21 by the ED in the excise policy case, the “whole government and its ministers of Cabinet are in jammed mode” and the Delhi government and its administration are working like a “headless organisation”.

It states that to “fulfill responsibilities of the Chief Minister” of Delhi, Kejriwal’s “physical presence” is required at office and home “24 hours X 7 days a week to take quick decisions on all issues and to pass required orders and directions in the welfare of the public at large”.

The plea further states that “jail authorities and/or police officials cannot ensure” the safety and security of the CM because they are “not well-trained” for this.

Giving the example of gangster-politician Atiq Ahmed, the PIL states that while Ahmed was under police escort at Prayagraj, he was “killed by three clumsy assailants in police custody last year…” in the presence of police.

The PIL additionally states that the petitioner is giving his personal guarantee that Kejriwal “shall not try to influence witnesses”.
