A 15-year-old witness testifying on behalf of Vinay,one of the six accused in the December 16 gangrape,produced a video clip showing Vinay and co-accused Pawan at a music function at the time of the incident.
The minor had told Additional Sessions Judge Yogesh Khanna on Friday that he had accompanied Vinay to the function organised in district park after 8 pm. He said he had also seen Pawan at the event.
He testified that Vinay had been playing an instrument in the function and he had recorded the performance on Vinays phone.
The video clip and the minors testimony corroborates Vinays statement that he and Pawan were not present in the bus when the gangrape allegedly took place.
The prosecution believes that the evidence does not carry any value since,according to the minors testimony,the clipping was recorded on the memory card of the phone.
Vinay in his statement had said a friend of Ram Singh,who is also an accused in the case,had taken his phone for an emergency call on the night of the incident,and returned it the following day without the memory card.
The quality of the video is poor and neither the time nor the date of the recording shows on the frame, Dayan Krishnan,special public prosecutor said.
The prosecution had earlier submitted a letter issued by the Delhi Development Authority (DDA) which stated that they had not granted any permission to organise a music programme in the district park on December 16,2012.
Functions were prohibited in the park,since it is a protected forest and no one is permitted to enter the park premises after 7 pm during winter,the letter mentioned.
A list of events of the church,which allegedly organised the function,was also submitted. The list does not mention any such function.
Krishnan on Saturday moved an application before the court summoning representatives from the DDA and the church to testify whether such a function had been organised.
