The bail application for Rupak Jain, a co-accused in the Paytm extortion case, was rejected by a special judge of the Surajpur district court on Wednesday. Jain, along with his wife and key accused Sonia Dhawan, and a third accused Devendra Kumar had been sent to judicial custody by a magistrate on October 24 for allegedly blackmailing Paytm chief Vijay Shekhar with leaking confidential information to extort Rs 10 crore from him. Sonia is vice-president, Corporations/PR at Paytm.

During the hearing, Rupak’s lawyers argued that he was being framed at Shekhar’s behest and that he was, in fact, the victim of a conspiracy. They also argued that there is no independent charge against Rupak and he is being blamed on heresay.

The government lawyer, on behalf of complainant Shekhar, argued that there is sufficient evidence to establish Rupak’s role in the alleged conspiracy. The court issued an order of bail rejection soon after hearing arguments from both sides.

No bail application has been moved by Sonia and Devendra.

According to lawyers, the appeal to a higher court is imminent. “We have received the order copy of the bail rejection from court. We are going to examine the contents and decide on the next step, which is appealing against the order in the Allahabad High Court,” said advocate Satish Kumar.

With regard to Sonia’s bail application, her family is considering taking more time. “We cannot say for certain that we will move the district court for Sonia’s bail any time soon. At this point, our focus is on Rupak’s bail,” said Kumar.

Sonia’s family, meanwhile, said she is facing health problems in prison. “Due to lack of proper food, she is unwell. We have been able to see her for barely a few hours since she was sent to Kasna Jail. We cannot comment on her bail application, but we have a strategy in mind which will be executed as per the developments in court,” said her sister Rupali.

The family also replaced the previous lawyer and hired other legal counsel for the rest of the proceedings. The next hearing in Surajpur court is on November 19, which will deliberate the extension of Rupak and Sonia’s judicial custody.

The fourth accused in the case, Rohit Chomal, is currently absconding and police teams are trying to arrest him.
