Bailable warrants issued against Talwars

The CBI court of special judicial magistrate,Preeti Singh on Monday issued bailable warrants against Rajesh Talwar and Nupur Talwar.

The CBI court of special judicial magistrate,Preeti Singh on Monday issued bailable warrants against Rajesh Talwar and Nupur Talwar,the parents of murdered teenager Arushi Talwar in the Arushi-Hemraj murder case. The court rejected the exemption application submitted by the couple through their counsel.

The court has issued a bailable warrant of Rs 20,000 for each of the two. The next date of hearing has been scheduled on March 22.

According to the court,Nupur’s plea was rejected as she had already been summoned by the court for the hearing on Monday. Rajesh had submitted a bail application on June 6,2008,and that was rejected on June 10,2008,the court noted. He,therefore,was not given bail but was let off on furnishing bonds.

“After his arrest,Rajesh Talwar was sent to judicial custody after the expiry of police remand period. The CBI conducted enquiry into his role in the case through polygraph and lie-detection tests. On not finding any evidence,the CBI counsel requested the court to release Rajesh Talwar from judicial custody under Section 169 of CrPC,” the court order read.

“The court has issued summons to the couple by putting them under category of accused and they should have appeared before the court. No revision petition was filed by Talwars in the court concerned. Thus,the court issues bailable warrants of Rs 20,000 each against them,” the order added.

In Allahabad,Rajesh and Nupur filed a supplementary affidavit before the High Court citing a number of facts,which they claimed had come up during investigations but were overlooked by the special CBI court in Ghaziabad.

In their affidavit,the Talwars claimed that a DNA test conducted on November 6,2008 had concluded that the finger marks found on the terrace of their house,on a whiskey bottle found inside the house and on the pillow of another domestic servant Krishna,belonged to “the same person and most certainly a male”.

The Talwars also alleged they were denied access to Arushi’s computer,seized by the CBI for investigations,despite an application moved under the Information Technology Act.
