“...the murder weapon recovered from spot was sent for opinion to the doctor conducting postmortem, and the same doctor opined that the genital injuries can be caused with the said murder weapon,” ASJ Sahrawat saidA Delhi court on Tuesday convicted a man for raping and murdering a 60-year-old woman in November 2017 when he was a juvenile. A year after the offence, the Juvenile Justice Board had concluded that the child was required to be tried as an adult, following which the case was transferred to the court.
Additional Sessions Judge (ASJ) Amit Sahrawat of Rohini court, in his judgment dated October 28, said, “…it is also considerable that the CCL (child in conflict with law) did not just give blows of this rod on the body of the deceased, rather he mercilessly inserted this rod into the private parts of the deceased and caused fatal injuries inside her private parts.”
“…it is a proved fact that the metallic rod recovered from the spot was inserted by CCL into the private parts of the deceased and due to that the deceased sustained fatal injuries inside her private parts,” the ASJ added.
According to the prosecution, the woman had been living on a footpath in Delhi for over 15 years. While she was being raped, the eyewitness to the incident, a security guard, had tried to intervene and even raised an alarm, but was threatened by the then juvenile with a weapon.
While the woman was taken to a hospital, the juvenile was apprehended from his home the next day. The woman passed away three days later.
“The CCL inserted this metallic rod inside the private parts of deceased so mercilessly that even the flesh/ body part separating vagina and anus also got torn,” the court said. “These injuries leaves no doubt in observing that CCL was not just intended to cause death rather he was determined to cause death…,” it added.
Along with the testimony of the eyewitness, other evidence against the juvenile were the weapon that was recovered from the spot and the forensic report, which pointed out that the woman’s blood was found on his clothes that were recovered from his house.
