Consumer body orders electronics store to change TV or refund buyer

The Chandigarh Consumer Disputes Redressal Forum-II has directed an electronics goods showroom in Sector 35 to refund Rs 13,500 to a resident of Sector 32,and take back the defective LCD sold to him.

President of the Forum Lakshman Sharma and Members Madhu Mutneja and Jaswinder Singh Sidhu have also directed the showroom to pay compensation of Rs 7,000 to the complainant,along with litigation charges of Rs 5,000. In his complaint,Mohinder Singh had stated that he purchased an LCD TV from the showroom in October 2009,for Rs 13,500.

Singh claimed that the TV did not function properly from the very beginning,and used to automatically get switched off after every 30 minutes. He lodged a complaint with the authorised service centre of the company,which sent a service engineer to look into the problem. Singh said the service engineer changed the power supply of the TV,and said the problem had been resolved.

Despite this,the complainant continued to face the problem. Ultimately,the customer care centre told Mohinder Singh that they did not sell the particular model of LCD any more,and would not be able to replace it with a new one.

Singh stated that the service centre of the company offered to replace the TV with a new one,if he paid the difference in price. Singh told the court that the opposite parties asked him to pay Rs 3,490 for the model selected by him,which was priced at Rs 16,990. Singh found that the price of the old LCD printed on the carton was also Rs 16,990. Hence,the opposite parties were not justified in demanding Rs 3,490 from him.

Singh then issued a legal notice to the opposite parties demanding the replacement of the defective LCD,or refund Rs 13,500. In his reply,the representative of the showroom stated that the complainant did not produce any expert report with regard to the alleged defect in the TV.

After considering the case,the Forum observed that the showroom had been guilty of deficiency of service towards the buyer. In this light,the Forum directed the owner to compensate Mohinder Singh accordingly.
