The Punjab and Haryana High Court has issued a notice of motion to the state government for July 19 and stayed further proceedings pending before the trial court in a case where two different actions were recommended after holding parallel inquiries and letters were issued on the same diary number.
The case began in October 2009 after Bikkar Singh Sandhu,a resident of Moga,filed a complaint with the then SSP Ashok Baath alleging that his daughter was being harassed by her husband Harmandip Singh for dowry.
The couple lives in Canada and have filed for a divorce there. The inquiry was handed over to Gurmeet Singh,the then DSP(D) at Moga. It was learnt that the police officer conducted two parallel inquiries and recommended two separate actions in a month later in the same year. In the first inquiry report,the DSP recommended that there was no substance in the complaint and it should be closed. The SSP while accepting this report on November 24 ordered to close down the case. In the second inquiry report,bearing the same diary number,the DSP states that the complaints were right and a legal action should be taken against Harmandip and his family members. The SSP accepted this report also and ordered to register an FIR after seeking legal opinion.
Following the second report,an FIR under Sections 498-A and 406 of the IPC was registered against Harmandip Singh and his family members on December 12,2009. Surjit Singh Brar,father of Harmandip Singh claimed,We came to know about this goof up and decided to take the matter to the court. We filed a criminal writ petition before the high court last month mentioning how the Moga police had taken divergent actions on two parallel inquiries of a same complaint and also did not look into the case pending before the Canadian court before registering a criminal case against us. The Punjab and Haryana High Court took a serious note of this act of the Moga police and issued a notice of motion to the state government.
