MP Raghav Chadha’s resolution seeking to streamline the process of judicial appointments in line with the directions of the Supreme Court was listed by the Rajya Sabha on Thursday. The resolution aims to uphold the independence of the judiciary, which is a fundamental part of the Indian Constitution.

The resolution provides for the Rajya Sabha to demand that the Government of India (GOI) expeditiously finalize the Memoranda of Procedure for the appointment of Judges to the Supreme Court of India and High Courts. It further incorporates provisions such as a 30-day deadline for submissions of observations, comments, and intelligence inputs to the Collegium after it recommends names for elevation. The GOI must either accept the recommendation or return it for reconsideration within the specified time frame.

If the GOI fails to act within 30 days, the recommendation of the Collegium will be forwarded by the Secretary, Department of Justice, within seven days to the President of India for issuance of a warrant of appointment. If the GOI returns a recommendation to the Collegium for reconsideration and the Collegium reiterates the recommendation, the Secretary, Department of Justice, shall within 15 days forward the recommendation to the President of India for issuance of a warrant of appointment.

The resolution aims to ensure that appointments are made in a timely and transparent manner, thereby safeguarding the independence of the judiciary. This move comes after the Supreme Court directed the GOI to finalize the Memoranda of Procedure in consultation with the Collegium, which is responsible for recommending names for appointment to the higher judiciary.

The resolution will be taken up for discussion and voting in the upcoming Rajya Sabha session.
