Petition says officers manhandled,misbehaved with complainants

With the Chandigarh Police allegedly refusing to register a case on the complaint of a Manimajra resident whose motorcycle was stolen more than three weeks ago,the latter has moved the Punjab and Haryana High Court,seeking action against the police. The petition filed by Sanjay Sohil and his brother Sanjeev Kumar also accuses officers of the Manimajra police station of misbehaving with and manhandling them. The petition is likely to come up for hearing this week.

According to the brothers,the two-wheeler (HP-12C-2142) was stolen from Bank Colony,Manimajra,on the intervening night of February 28 and March 1. Sohil went to the police station on March 2 and gave a written complaint to Sub-Inspector Rajinder Prasad. The officer visited the spot and questioned Sohil’s landlord and others living in the colony about the bike,but they expressed ignorance,reads the complaint.

The S-I then asked Sohil and Sanjeev to produce witnesses to corroborate their complaint. “My cousin told the police that he had last seen the motorcycle at 10.30 pm on March 1. But the officer refused to record his statement,” said Sohil. Sanjeev spent the entire day in the police station requesting the officers to register an FIR but to no avail. “He was asked to come on March 3. My brother complied,but the police did not budge,” alleged Sohil.

On March 4,Sanjeev,Sohil and their two cousins went to the police station again. “The S-I came at 4.30 pm and asked us to return at 6 pm,saying the FIR would be registered after he had consulted the station house officer (SHO),” said Sanjeev. When the four returned at 6 pm,the SHO allegedly misbehaved with them. “He said we were telling a lie and refused to register an FIR,daring us to ‘approach anyone’. We were pushed by the officers and shooed away from the police station,” adds the complaint.

Advocate Ranjan Lakhanpal,Sanjeev’s counsel,said: “Why would anyone go to the police and make a false statement that his motorcycle has been stolen? If they can’t register an FIR in a case as simple as this,what else can we expect from the police force which claims ‘we care for you’?”
