A 19-year-old youth who works as a sweeper at the Pinjore Municipal Committee has been held guilty of culpable homicide not amounting to murder by a local court here on Wednesday,after he hit his father with a cement tile,causing his death.
The youth,Manish,got enraged after his father beat up his mother while in a drunken state.
The court of District and Sessions Judge,Ravi Kumar Sondhi,convicted the 19-year-old,Manish,under Section 304 of the IPC and will pronounce the quantum of sentence on Thursday. The scientific evidence,that included the matching of the hair sample of the accused with the hair strands found with the bloodstained cement tile,as well as the postmortem report of his fathers body,suggested that the death was caused due to multiple fractures on the head.
The defence had pleaded before the court that the death of the father of the accused,Raguveer,was caused after he fell down from the charpoy at his house in Pinjore,but the postmortem report pointed out that the death had been caused due to multiple fractures on the head.
District Attorney Amit Parmar,who pleaded the case in the court,said the circumstances pointed towards the guilt of the accused and the explanation given by the defence in the court was not probable.
The incident had happened last year and the landlord at whose house the family was living had complained to the police about the incident. The accused,Manish,who is out on bail was booked for murder on the basis of the complaint by the landlord.
The complainant had however become hostile in the court and had not supported the case of the prosecution. The prosecution however relied on a part of the statement of the complainant,in which he had stated that the accused and his mother had narrated the circumstances leading to the death to him.
The postmortem and the forensic observations had shown that the death was caused due to injuries on the head and that the person who died was excessively drunk
