The Punjab and Haryana High Court has ordered an investigation into what it described as a “prima-facie fake” medical certificate submitted by the Karnal DSP Pooja Dabla, who had failed to attend court proceedings regarding a rape case.
Taking serious note of the facts on record, a division bench comprising Justices Surya Kant and P B Bajanthri has now directed the Karnal SP Pankaj Nain to look into the matter and file a detailed report within 10 days. Dabla, a Haryana Police Service officer, was heading a special investigating team (SIT) to look into the alleged rape of a minor in 2014.
The court had last month directed the SIT to re-look the issue and submit a supplementary report on the question of juvenility of the accused in the case. As per Haryana government’s August 4 orders Dabla has been transferred to Rewari.
“SIT is said to have been constituted headed by one Pooja, who is stated to be a deputy superintendent of police. No supplementary report has been produced or filed,” the court observed. The division bench further went on to record its anguish in the order and said, “In fact, the officer heading the SIT has sent medical certificate of her ailment which is prima-facie fake. The Superintendent of Police, Karnal is directed to file affidavit whether the police officer is on leave today and if not, how is she performing duties when she is unable to travel to attend the Court proceedings?”
Dictating the order, Justice Kant added, “If it is found that she is not performing duties and has not taken leave also, we are sure that the state government knows what action is required to be taken.”
The court ordered that in the meanwhile, there shall be liberty to the SIT to comply with the earlier court orders in accordance with law and take the investigation to its logical conclusion, uninfluenced of the claim or counter-claim of either party.
The court further expressed, “Having regard to the reckless and casual approach of the investing agency in handling the subject-case, the SP, Karnal was summoned who undertook to appoint a SIT headed by a woman Police Officer in the rank of DSP. Accepting his statement, we directed the proposed SIT to re-look the whole issue and submit a supplementary report on the question of juvenility of the accused.” But the SIT head neither filed the report nor did she come to court to apprise of the case development, the court said.
