Blaming his close relatives for creating differences between him and his father,advocate Suvir Dewan on Tuesday said that it would be difficult for him to vacate the house in which he has lived for the past 50 years. The one kanal house,in Sector 11,has become the bone of contention between Dewan and his father,Shanti Sarup Dewan,former Chief Justice of the high court. After the mediation attempted between the warring father and son had failed,the high court in the last hearing had asked Suvir to decide whether he would like to vacate the house and become entitled to one third of the property or live in the house and restrict his claim to only 20 per cent. On Tuesday,Suvirs counsel informed the high court that he would like to stay in the same house with his wife and daughter. Another application was filed by Suvir in which he has argued that his share cannot be confined to 20 per cent on the property. Suvir,a lawyer practising in Punjab and Haryana High Court,has submitted that as per Hindu Undivided Family Act,his two sisters had no claim on the house and that his share cannot be reduced to 20 per cent. Suvir read out an affidavit,filed by him earlier,in which he has alleged that his close family members are responsible for the differences between him and his father. On the other hand,counsel for Justice Dewan opposed the claim made by Suvir,arguing that at such an old age,it will not be possible for the retired chief justice to approach a civil court and get involved in a litigation over the share of the house. After hearing both the parties,the high court reserved orders on the pronouncement of the case. To settle the feud,the high court had set up a committee of three mediators,including a retired Supreme Court judge and a senior lawyer. The high court was informed on the last hearing that Justice Dewan had disinherited his son from movable and immovable properties in his will. Suvir has a house gifted by his father,in Panchkula.
