For taking no action on the original complaint and instead registering a case against the complainant,a Mohali Court has raised eyebrows over the FIR registered by the Mohali Police against a bank manager on charges of extortion.
Tarun Khullar,a manager with HDFC Bank and his friend Amandeep Singh were booked by the Mohali Police last week on charges of extortion on the complaint of one Kamaljit Singh,owner of Haveli restaurant in Phase-V,Mohali. The owner alleged that the bank manager and his friend were trying to extort Rs 2 lakh from him after having found parts of dead rat in a meal served to Khullars family at the restaurant.
Apprehending arrest,the two moved the Mohali Court through Advocate Sahil Kaushal,earlier this week,seeking anticipatory bails. Allowing the same,the Mohali Court has raised question marks over the inaction of Mohali Police on the original complaint by Khullars wife.
Smelling a rat,the court observed,From the record it has come to light that though Reshmi Khullar wife of Tarun Khullar has made the complaint to the SHO,Police Station,Phase-I,Mohali,nothing seems to have been done in this regard. Rather,husband of the complainant and one Amandeep Singh has been booked as per the present FIR.
The court also took note of the assertions made and photographs produced by the accused. The bail applicants produced on record the photographs of the dead rat in a plate lying on the tissue paper on which Punjabi Haveli is written, reads the order.
Directing the two to join the investigation,the court made it clear that in case of arrest the two will be released on bail in accordance with law and compliance of necessary provisions of Criminal Procedure Code.
Therefore,in view of the totality of the facts and the circumstances,I deem it proper that the bail applicants be allowed to join the investigation. Accordingly,bail applicants are directed to join investigations with the Investigating officer of the SAS Nagar,Mohali police around 11 am.
However,in the event of arrest of bail applicants,they should be released on interim anticipatory bail,on their furnishing bail and surety bonds to the satisfaction of the arresting officer/investigating officer,subject to compliance of provisions of Sections of Criminal Procedure Code, reads the order.
In the complaint,it was submitted that Khullars wife found parts of a dead rat in the pickle. Shocked,she confronted the waiter. By then other customers also gathered.
Khullar also produced photographs of the dead rat in the pickle. It has been submitted before the court that the owner of the hotel rushed Reshmi Khullar to a private hospital.
