Court gives CS six weeks to file details on corruption cases

Annoyed over delays by the state’s home department,Himachal Pradesh High Court on Thursday gave six weeks to the chief secretary (CS) to furnish information regarding cases of corruption and 'moral turpitude’ pending against government servants in all departments for the past 10 years.

A division bench,comprising Chief Justice Kurian Joseph and Justice D C Chaudhary,passed the orders during the hearing of a petition filed by Sher Singh Thakur,a former drug controller convicted in a corruption case. Thakur had sought quashing of the departmental proceedings against him,which were ordered when the criminal trial was pending.

The State Vigilance and Anti-Corruption Bureau had arrested Thakur in 2008 with cash,which he had allegedly received from industrialists and promoters of pharmaceutical units in Baddi Barotiwala area. Later,he was convicted by the court.

Acting suo-moto in a separate case,the High Court also directed chief secretary to furnish the list of officers of doubtful integrity and also inform the action taken by the government.

During the hearing of the petition,the court observed that since November 2011,the court had been directing the principal secretary (home) to furnish information regarding officers involved in corruption cases. But the principal secretary (home),through an affidavit dated May 9,2012,had informed the court that this would take a lot of time and effort,as the information was to be consolidated by the administrative secretaries concerned.

The court recalled that the period from November 2011 to May 2012 would have been sufficient to call for information and supply the same to the court. “The court wonders,what they had been doing for the said six months. Being a home secretary,major part of information could have been easily available from the police headquarters. There is no point in waiting for the report any further from the home secretary,” the court said.

It,thus,directed the chief secretary to furnish the information within six weeks. The matter will be listed on October 31,2012 for further hearing. Inquiries reveal that some of the government servants facing corruption cases were also promoted.
